Judge Aileen Cannon on Monday tossed former President Trump’s case over his alleged mishandling of classified information, ruling that special counsel Jack Smith was not lawfully appointed.

The ruling hands a major victory to Trump, marking the first time one of his four criminal cases has been dismissed entirely.

“The Superseding Indictment is dismissed because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution,” Cannon wrote in a 93-page ruling.

- The Georgia case is mired in appellate limbo and is likely to be dismissed due to the Democratic prosecutors fucking each other

Next - since Jack Smith was never lawfully appointed and is simply a private citizen filing legal briefs, the next Trump Administration should require he repay the U.S. Treasury his entire salary from the time he began work.

John Luman Smith is an outstanding Harvard law school graduate and head of the Department of Justice's Public Integrity section. He was also the chief prosecutor at the Kosovo Specialist Chambers, an international tribunal at The Hague tasked with investigating and prosecuting war crimes in the Kosovo War.

Saxitoxin fails to mention that the Judge issuing the finding that Jack was unlawfully appointed has been derided as the worst federal judiciary appointment in history with a criminal husband and devoted to the corrupt man who appointed her, whose case she just dismissed after delaying the trial for months.

Many legal experts, citing her poor handling of a civil case against Trump, called for Judge Cannon's recusal from the case. Under Cannon, the case was considerably delayed from getting to trial, with Cannon granting multiple requests by Trump to extend pre-trial motions.
Cannon was born in 1981 in Cali, Colombia and has a mother who fled Cuba under Castro. In May 2024, NPR reported that Cannon had violated internal judiciary rules and federal ethics law when she did not timely disclose that in 2021 and 2022, she was privately reimbursed when attending two legal seminars ("Sage Lodge Colloquium") at a luxury resort in Montana organized by George Mason University, and only disclosed it when NPR enquired about the matter; Cannon was the subject of ethics complaints over the handling of her Trump civil case, but these were dismissed. She was strongly rebuked for her tortured reasoning favoring Trump on appeal, including favoring arguments his lawyers had not presented.
On June 20, 2024, The New York Times reported that shortly after being assigned the criminal documents case, two federal judges in South Florida, including the chief judge, Cecilia Altonaga, privately urged Cannon to decline the case and pass it on to other jurists. However, Cannon had not taken their advice.
The ruling to dismiss the case has led to calls for her impeachment and denunciations of the absurd claims by Thomas and Cannon on the legality of some special prosecutor appointments. Over 1,000 complaints have asked her to be removed from the case or the bench.
Aileen Cannon is married to Josh Lorence, who works for convicted felon John Rossatti, a mobster and Trump supporter. Trump has many connections to New York mobsters expediting his construction projects.

Jack Smith has failed in every major case he prosecuted. Notice Gary doesn't name any notable victories of Smith, he just says he's "outstanding" and begs us to believe him.

I, however, will be specific in pointing out his record of utter failure and incompetence.

- Jack Smith prosecuted John Edwards in what was supposed to be a slam dunk case. The case ended in a mistrial and the DOJ, reviewing Smith's materials, decided not to move forward.

- Jack Smith prosecuted Robert McDonnell, governor of Virginia, for public corruption. Another slam dunk case that was marred by procedural mistakes Smith made. Despite landing a conviction, the Supreme Court reversed it in a unanimous decision, citing Smith's buffoonery.

- Jack Smith prosecuted Bob Menendez (the first time). His haplessness led to Menendez walking free. A few years later, DOJ assigned a more competent prosecutor and Menendez (last week) was convicted after a one-hour jury deliberation.

After all those, and a string of less spectacular failures, he was finally shipped abroad to the Kosovo tribunal. That wasn't a promotion. The DOJ exiles the dumbest of its lawyers as seconded counsel to international courts. Saul Goodman is a better lawyer than Jack Smith. Smith is universally regarded as one of the dumbest of the dumb. And he just added another major "L" to his record of impotence: both of his Trump prosecutions failed utterly and completely. The nine lives of the failed career of this career failure are almost done. No one will give him another chance after this.

Four AUSAs in the EDNY get this annually - there are 150 AUSAs in EDNY ... if you spend 10 years in the EDNY you basically have a 1-in-4 chance of getting it. If you don't get it, it may be because you got a more prestigious award. Basically, as long as you're average to slightly above average, you'll get the Rose Award. It's another participation ribbon.

Long story short, Jack Smith's awards panel is very unimpressive for an attorney of his tenure. Far from anything impressive, it's a monument to failure. I'm surprised he didn't list his 3rd Place Ribbon for his Elementary School Field Day.

Many legal scholars have long been highly perplexed why Garland appointed an attorney with Jack Smith's losing track record to prosecute the crime of the century. If you were Trump's best friend you couldn't have selected a more bumbling attorney likely to lose than Jack Smith. And lose he did.
