I fought the law, and I won.............

I received a citation two months ago for running a red light. I had no doubt in my mind that the light was still yellow when I entered the intersection. I submitted a request to get the dashboard camera video from the police car that stopped me. Lo and behold when I received the video it clearly showed that I was in the intersection as the light was still yellow. I plead Not Guilty and requested a trial before a judge.

I went to court today and represented myself, boy was I nervous. You know the saying; A man the represents themselves in court has a fool for a client. The prosecutor started his case by calling the police officer that gave me the citation. He asked the officer all kinds of legal question about how, what, when and where. He asked this one question about did he see me run the red light. The officer said that he was sitting in the left turn lane waiting for a green light to go. As he waited he noticed my vehicle enter the intersection after he got the green light to go.

Then it was my turn to ask him some questions. I asked if he was 100 % sure that he had the green light when I entered the intersection. He said yes, 100 % sure. I said I had no more questions.

Then it was my turn to testify and I said to the judge that I had evidence that proves I was in the intersection when the officers' light was still red. He looked kind of surprised and asked if I could show this evidence. He let me use the court computer and I played the video.
When it showed that the officer was not being truthful, he looked at the prosecutor and then the officer and then at me. I said it clearly shows that I was in the intersection while the officers' light was still red.

The prosecutor then called the officer back up. They tried to make the case that there is a delay in the light and that I did run the light. I asked the officer are you sure about the delay as much as you were sure that I entered the intersection after your light turned green?
All he could say was that it was his contention that I ran the red light.

I also asked what constitutes running a red light in the state of Texas? He said that entering an intersection and not stopping at a red light. I asked him if there was a crosswalk at the intersection, he said yes. I asked him if there was a stop line or stop bar at the intersection, he said yes. I asked him if he could see the front of my vehicle cross the stop line, he said yes. I asked him if he could see my light turn red, he said yes. Then I asked if he could see the front of my vehicle and the light at the same time, he kinda stammered and said well, and I immediately said answer yes or no, please. He he had to say no, but it was his contention that I ran the red light.

I rested my case.

The judge asked the prosecutor what he contends and the prosecutor said he contends that I ran a red light.
The judge asked me what I contend and I said I contend that I was in the intersection while the light was still yellow.

He then spoke these words, " In light of the evidence presented here today. I find that I have to dismiss this case."

I looked at the judge and asked if I'm free to go and he said," Yes, you are free to go."

So, if you have a problem, don't take the law into your own hands.
Take 'em to court. Traffic court. :lol: :lol:

In the officer's deffence he probly thought you had run the light. From your story it sounds like you might have caught the yellow near the end of it being yellow. So as he looked back he would have seen your car leaving the intersection with a red. Just saying the officer likely wasn't lying that he thought you had run a red, he was simply mistaken.

That's right. The light was turning from yellow to red.

Almost certainly. However, why didn't the police officer (or more importantly the prosecutor) at least look at the damn vehicle video themselves? I mean, seriously!

I actually had a friend who got fined for 'failing to stop at an orange light' - they didn't say she ran a red light, but failed to stop at an orange.. it was retarded. The cop was on her 2nd day on the job...

Great job! You did that in Texas though. Time to move.

I honestly read that title wrong, and thought the law had won, I was sick to my stomach reading it, until I read the end, and the title again. The damn song trumped what I had read the first time.

I like cops, the good ones are great. They really are. But the ones willing to lie through their teeth so tarnish the entire point of their existence that it is sickening. Imagine perjuring oneself, for the sake of giving someone a ticked for going through a yellow light? Guys like that ruin the entire image of the real cops that put their lives on the line for us every day, who only ask for an extra 20 hours of overtime in details every week as thanks. ;)

I'm joking with that last part of course. Ive been very lucky to have met some tremendous cops, and know that they are the norm, its just too bad there really are some that are beyond sub-par. At the same time, the cop saw you go through the intersection, his light probably turned green a second later, you probably were going fast enough to get his attention, and he probably wasnt as much lying as he was remembering incorrectly...or inventing the memory. That would have been a fun case to watch on Video though. So, could you see the front of my car and the light at the same time? Duh...ummm....no...

You were probably .5 seconds from actually going through the red light. Dont speed in front of that guy again, or better yet...drive in front of him.

I thought if you see an orange you should stop unless you are already across the line or are too close going too fast to be able to break before the line or will cause a dangerous situation in doing so...That was my understanding anyway.

On traffic related laws, had an epic drive on Tuesday night. My college Xmas Ball was being held in a hotel about 40 miles away so me and my friends decided to drive there instead of catching the coach so we could get to our rooms early and enjoy the pool and gym etc.. Come 1930, my friend realises he forgot his shoes so we need to head all the way back to campus and then back to the hotel (80 mile round trip). He had a few drinks by this point so I accompanied him back just incase he was too bad to drive so I should take over, and luckily about 90% of the trip was just straight down the motorway. His driving was fairly bad but good enough so I didn't have to take over, averaged about 110-120mph over the two legs. If there had been one cop car on that 80 mile stretch he would have been done for drink driving and speeding (with no chance of winning in court), but on the plus side, we got back in time for the meal and had a great Xmas Ball.

About the speeding part I forgot to mention that the prosecutor tried to get me on that issue also. He was asking me some questions that I would answer yes to, like, Is my name so and so..........Do i live at so and so..........about a dozen or so. Then he asked me if I speeding through the intersection. I said no I saw the light change from green to yellow and in my opinion it would have been unsafe to stop, so I proceeded through the intersection. I guess he thought I would just keep saying yes. :lol:
