Though as rd pointed out it's more directing people to work things out with others in their church rather than taking them to court. It loosly suggests you should be able to judge things if you use a little sense. It is part of several things written in the bible that expand on the idea in my opinion. I think the basic direction is not a blanket "Do not judge." so much as. "Be reasonable when you judge."
I think what I did further supports that many thing's contained there are too complex and can't be neatly settled with a sentance or two, perhaps.
I would liken religion more to a venereal disease than a dick. Both men and women have venereal diseases, and they spread quite easily through contact. They also tend to pass along the generations like a cold sore, and it is more of an acquired thing that something you are born with (apart from HIV). People are certainly hesitant to get anywhere near other STDs, especially if they already have some. It's those whom don't have STDs who tend to laugh at all the silly commoners with their diseases, because all they had to do was choose their partners and not let their guard down to prevent infection.

This seems like an informed and unbiased analysis.
