OPEN border? Do they let anyone and everyone IN? without documentation? without "permission"?
That is basically what is happening at the US-Mexican border. An immigrant requests asylum and he/she is IN, basically.
That's not exactly accurate. Under international law, and asylum seeker has a right to stay until his case is heard. For many years, the U.S. didn't hire enough judges to hear all the cases, and the backlog grew. Eventually, your country gave up even trying.
Some of the refugee claimants that don't have their cases heard disappear into the country and become
de facto residents. Others are deported under various pretexts. It's basically wrong either way, and it's really the luck of the draw whether someone illegally stays or is illegally deported. The problem could be solved easily: develop clear and consistent rules for what constitutes a valid claim. aggressively increase the number of judges and have them work dawn to dusk clearing cases until cases can be heard in a reasonable amount of time.
It really wouldn't be a difficult fix. The reason you don't fix it is that, like all rich countries, you teach your kids that everyone who gets through school will get a high-paying white-collar job. Like all rich countries, your native-born citizens won't do the dirty, menial jobs that still need doing. You have a chronic labour shortage at the low end of the scale, and these "illegals" that you slander so much are the life blood of your economy. That's why Congress won't act, because while they would never admit it publicly, they know damn well that without illegal immigration, your economy is fucked.
