Draco as a normal student is strange in that he is pretty scummy in the books, but at the same time I believe that it is possible. Hogwarts needs to have students in and he is one of the more well known ones besides, harry, hermione, and ron. If this game is based off of the books, there are enough death eaters out there to use them as the actual scum and allow someone like drago just to be regular students.

I think that the claim of Draco Malfoy being town, is probably true. BUT because of the fact he is so evil. Why would someone fake claim someone evil as town? THEY WOULDN'T UNLESS THEY ARE THAT DUMB!
