How much should Kraft be made to pay this poor woman?

$5m, exactly as she asked

$50m, to set an example

Kraft sued for cheese fraud

Postby bigtoughralf on Thu Dec 01, 2022 5:01 pm

This lawsuit against Kraft reads like jp4 trying to make his signature Bachelor Rice sound complex:

  • Open packet
  • Turn packet upside down
  • Pour contents onto plate
  • Look into packet
  • Ensure all contents have left packet
  • etc etc

A Florida woman has sued the makers of Velveeta Shells and Cheese, claiming the dish takes too long to make.

The Kraft Company markets its microwaveable cups as "ready in 3.5 minutes" but Amanda Ramirez says it takes longer.

The $5m (£4.2m) lawsuit claims the time advertised does not include preparation time - opening the lid and sauce pouch, before adding water and stirring.

They probably could have found a better case to test 'truth in advertising'

I wonder what lawyer is taking this on?

Seems like a losing case.

Hoping for quick cash settlement to end the publicity?

A reasonable judge would award her $5000 but she would have to pay all legal fees for both sides.

I think the obvious legal case here is not how long it takes but rather the name of the product itself.

Kraft “Mac & Cheese”.

Where the f*ck is the cheese?

It might be cheese ‘flavored”… and that powered shit might have been cheese once at some point in history.

… but calling it cheese is kinda offensive no?

"Reasonable judge"

The American Rule is a rule in the U.S. justice system that says two opposing sides in a legal matter must pay their own attorney fees, regardless of who wins the case. The rationale of the rule is that a plaintiff should not be deterred from bringing a case to court for fear of prohibitive costs.

The English rule provides that the party who loses in court pays the other party's legal costs. The English rule contrasts with the American rule, under which each party is generally responsible to pay its own attorneys' fees, unless a statute or contract provides for that assessment.

My points as poorly presented as they were, are.

She's right. It probably takes her way longer than a normal person to make the stuff.

Also... Perhaps Kraft should not advertise that a fatty can be burning our mouth in 3.5 minutes, when as she said, there were other steps in addition to the 3.5 minutes cook time.

Going to court and attempting to sue Kraft about it SHOULD be punished except they can't just blatantly punish the plaintiff since she is sort of "right".

Anyways. Fair enough, I should not be telling Florida how to run things.

Well, did she get enough in a settlement to buy a new import automobile and a life time supply of Kraft Dinner, or what?

Coincidentally I paused in the Mac N Cheeze area of Co-op today plus Mrs dimes made some Annie's shells with cheese today.
